IMPORTANT INFORMATION ABOUT YOUR ORDER

If the group is reduced to fewer than 4 participants, we reserve the right to consolidate groups or to reduce the total number of lessons.

Due to flexible organization, actual instructors may change on multiple occasions.

We reject any liability whatsoever for all accidents which may occur during or before ski lessons. Accident and liability insurance are a personal matter for course participants.

Fee reimbursement due to injury or illness is only possible with a medical certificate from a local doctor. Only unused days (remaining difference) are reimbursed.

Lessons canceled due to prevailing weather conditions (force majeure) are not refunded.Private courses are held in all weather conditions.

The course ticket is non-transferrable! Unused course days are forfeited!

Fees for ski courses do not include use of ski lifts. The ski school does not provide compensation for instructional time lost due to interruptions in lift service.

All deliveries and services of the ski school resulting from online bookings via the internet or other online services  as well as bookings in our office or by mail are subject to these terms and conditions.

Prices are subject to change without notice.

ONLINE CONTENT

The ski school / ski rental center (hereafter referred to as "author") assumes no liability whatsoever for the topicality, correctness, completeness or quality of the information provided. Liability claims against the author, related to material or ideal damage and which have been caused by the use or improper use of the information provided, or by the use of inaccurate and incomplete information, are expressly ruled out in so far as the author has not acted in a way which is demonstrably either intentionally or grossly negligent.

All offers are subject to change and are non-binding. The author reserves the expressed right to amend, add to or delete parts of pages, or the entire offer, without special notice.

REFERENCES AND LINKS

With regards to direct or indirect references to external Internet sites ("links") which are themselves outside the field of responsibility of the author, liability for illegal content will only then be assumed if the author has knowledge of the content of those sites and it is technically feasible and reasonable for the author to prevent usage of said sites.

The author hereby expressly declares that, at the time links were installed on this site, no illegal content was apparent on the targeted sites. This declaration applies to all links placed within its own Internet site, as well as to entries in mailing lists created by the author and to comments in the photo gallery.

COPYRIGHT AND TRADEMARKING

The author makes every effort in all publications to respect copyright on all graphics, audio files, video clips and texts, and to make use of self-created graphics, audio files, video clips and texts, or to avail himself of non-licensed graphics, audio files, video clips and texts.

All those brand names and trademarks cited in the author's Internet platform, some of which are, on occasion, protected by third parties, are subject without restriction to applicable copyright laws and the proprietary rights of the registered owners. The conclusion should not be drawn from their mere naming, that trademarks are not protected by third-party rights.

Copyrights for those objects published and created by the author himself, remain solely with the author. Duplication or use of such graphics, audio documents, video clips and texts in other electronic or print publications, is not permitted, except with the expressed permission of the author.

 

RENTAL AND RESERVATION OF SKI AND SNOWBOARD EQUIPMENT

Each person renting equipment is liable up to the full retail price of the rented items for the return of equipment in a proper condition.

The rental business is entitled to demand some form of security, be that a security deposit or the leaving of an identification document (i.e. passport, official I.D., driving license). Such a security does not constitute a possible purchase price for the equipment.

Picking up your rental equipment

The rental object can be picked up from 2:00 p.m. one day prior to the rental agreement without incurring any additional costs.

The customer must inform himself about the respective opening hours of the rental shop.

Delayed picking up of rental equipment

If the booked sports equipment is received by the customer too late or not at all, the rental price will not be refunded.

Cases of force majeure such as unfavorable weather or other influences that are not within the sphere of influence of the rental shop do not entitle to the free cancellation of the booking.

Return of rental equipment

The customer must return the rental property on the last day of the agreed rental period before close of business. The latest return date is at 06:00 p.m.. After that, the customer has to pay the full rental price for the next day.

Earlier return of rental equipment

If the rental goods are returned early, you will not receive a money refund.

In the event of illness or injury to the customer during the rental period, the person directly affected receives a prorated reimbursement of the rental price upon presentation of a medical certificate. This is only possible if the rented equipment is returned to the rental shop as soon as possible after the illness or injury occurs. The customer will then be refunded the rental price already paid minus the rental time already used.

Delayed return of rental equipment

In the event that the rental items are used for a longer period and after consultation with the rental shop, the difference between the rental period actually used and the rental period already paid must be paid on site at the usual rental prices.

Exchange of rental equipment

The exchange of the rental object during the contract period for equivalent articles within the same rental category is possible at any time free of charge. If you switch to a higher category, the surcharge must be paid on the spot according to the price list. No money will be refunded when changing to a lower category.

Care obligations for rental equipment

The tenant is fully responsible for the rental property.

By completing the booking, the customer confirms the correctness of their personal data, which are used for the professional setting of the sports equipment. It is expressly pointed out that the customer may not change the setting made by the rental shop without authorization.

All rental skis have high-quality safety conditions. The personal setting value is made manually based on age, gender, weight, height, driving speed and driving ability. The setting values ​​are not checked electronically with a measuring device. Snowboards and cross-country skis are not equipped with a safety binding.

The rental shop checks the rental equipment for defects. If the sports equipment already has defects when it is rented, the customer has the option - if the rental shop cannot remedy the defect - to have the sports equipment exchanged or, if this is not possible, withdraw from the contract.

The customer is fully responsible for the rented sports equipment and must only use it carefully and in the usual manner in accordance with its function and operating conditions.

Passing on the sports equipment to third parties is not permitted.

The customer must ensure that the sports equipment is stored in such a way that it cannot be mixed up or stolen.

Adequate safekeeping is the separate storage of skis or safekeeping in a ski depot. At night, safekeeping in a locked ski room in the accommodation or in a locked vehicle represents adequate safekeeping.

The rented sports equipment is not insured unless the customer takes out insurance (e.g. breakage or theft insurance). The customer has to pay for this himself.

Alpensports GmbH offer the following insurance - this must be explicitly booked by the customer himself and is not automatically included in the rental: The additional insurance is only valid for skis and snowboards and must be taken out and paid for in advance.

For a protection fee of € 2,50 per day we take the risk of breakage or a non- intentional damage.

In case of theft with the protection fee a deductible depending of the category must be paid: € 150,- (kids, youth, STARTER) / € 250,- (BASIC) / € 350,- (TOP & Snowboard) / € 450,- (VIP))

In case of theft, intentional damage or breakage without the protection fee the calculated fair value must be paid.

We are not liable for damage to the rental property when driving on roads (this is prohibited by law - see § 87 StVO). The protection fee also does not apply to such damage! Depending on the degree of damage, a fee for the repair will be charged.

Section 87 StVO winter sports on roads

The practice of winter sports is prohibited on roads in the local area, on federal, state and priority roads, provided that such a road is not closed to vehicle traffic on the basis of the following provision or is unusable due to the weather conditions. If it is in the public interest and there are no significant interests in unhindered road traffic, the authority can, by regulation, exempt individual roads from the prohibition of winter sports and block them from other vehicle traffic.

PAYMENT

Onlinebooking: Credit card payments in favor of the ski school are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain where you enter and process your payment is owned and operated by TREKKSOFT.Please send an e-mail to support(at)payyo.ch for all inquiries regarding your credit card payments and chargebacks.

In our office /shop in Neukirchen you can pay cash, with debit- or creditcard.

CANCELLATION OF PRIVATE OR GROUP LESSONS

Cancellation at least 7 days before the start of the course = no cancellation fee

Cancellation at least 24 hours before the start of the course = cancellation / processing fee 5% of the paid course fee

If the cancellation is made at a later date, Alpensports GmbH is entitled to charge 100% of the booked services.

If you cancel during an ongoing service or do not show up on the agreed date, there will be no refund.

In the event of illness or accident, a prorated reimbursement of the unused course days will be made on presentation of a medical certificate from a local doctor. The amount to be reimbursed is recalculated based on the services actually provided for that period. This will reduce the total amount, but higher daily rates may be charged.

No refund will be given for weather-related course cancellations (force majeure).

COMPLAINTS

Any complaints and complaints must be reported immediately by the contractual partner on site (Alpensports, Marktstraße 213) to enable quick remedies and to continue to provide the service.

LIABILITY

Alpensports GmbH does not accept any liability for accidents that occur during, before or after class and the final race. Accident and liability insurance is the responsibility of the participants.

JURISDICTION, PLACE OF DELIVERY AND LEGAL OPTIONS

Place of delivery is the headquarter of the ski school / ski rental center. In the event of dispute, the court with jurisdiction at the location of the headquarters of the ski school / ski rental center will adjudicate the matter. All matters are governed by Austrian law. The contractual language is German.
